Landlords and the Law of Civil Forfeiture


Sounds a bit scary for landlords and it can be. A Civil Forfeiture is basically the federal government bringing a civil action against the property owner to confiscate the property and strip them of its property collateral. Potentially they could lose the lien rights under its deed of trust.


The Drug Enforcement Agency (DEA) started mailing landlords letters in light of the legalization of Medical Marijuana dispensaries. The letter bits of advice the landlords that under federal law medical Marijuana is still illegal and they have the right to confiscate the property under the Law of Civil Forfeiture.


Marijuana dispensaries are not considered a private resident. And so property ownership for marijuana businesses…
